Italy Is Pioneer in European Union to Pass Comprehensive Legislation Regulating Use of AI

Italy has become the first country in the EU to adopt a sweeping regulation governing the use of artificial intelligence, featuring enforcing jail sentences on those who employ the technology to inflict damage, such as producing synthetic media, and limiting child usage.

The conservative government declared that the bill, which aligns with the EU’s pioneering Artificial Intelligence Act, is a critical step in shaping how AI is utilized across Italy.

The goal is to encourage “people-focused, clear and safe AI use” while highlighting “innovation, cybersecurity and privacy protections”.

The bill establishes incarceration terms of between one and five years for the unauthorized spreading of AI-generated or altered material if it results in injury.

There will additionally be harsher penalties for employing the technology to commit offenses, such as fraud and personal data theft, and stricter transparency and human oversight rules regulating how the technology is used in workplaces as well as in a range of sectors such as healthcare, education, legal systems and sport.

Furthermore, minors under the age of fourteen will need guardian approval to access artificial intelligence.

When it comes to copyright, the law stipulates that creations created with AI assistance are safeguarded if they stem from authentic creative input, while artificially powered text and data mining will only be allowed for non-copyrighted information or academic studies by approved institutions.

A state representative remarked that the law “brings progress back within the scope of the public interest, guiding artificial intelligence toward development, freedoms and full protection of individuals”.

The government has designated national bodies to implement the law, which obtained its definitive endorsement in the legislature after a twelve months of debate.

Discussing the topic of artificial intelligence last year, the head of government commented: “There can and must be an Italian way when it comes to AI, an domestic method to advance AI and an Italian way to regulate AI.”

She viewed the technology to be “the greatest transformation of our time”, but said it could only achieve its maximum capabilities “if it is created within a structure of ethical rules that prioritize people and their entitlements and needs”.

The law permits up to one billion euros from a state-backed investment scheme to support businesses active in AI, cybersecurity and telecommunications, although critics argue the sum is modest compared with funding being made by other nations.
